Have another question regarding AP, we have filed 485 in jul 07, we got Recept for AP, but no other updated on AP, in case of Emargency can we go to the local office to get AP, is there any Rule that poeple applied AP for the first time will not get the same from local office.

check your AP application here https://egov.uscis.gov/cris/jsps/login.jsp and if is says approved then call your attorney. usually this AP approval goes to attorney if you use attorney during the filling.
if the online status is not yet approved then may be they are waiting for FingerPrinting to be done. Did your FP complete?

Hi,
I just saw on DOL website that my PBEC labor has been approved, on the other hand my old i-140 is stuck in NSC filed Sept 9th, 2006 EB3.
My question is how can i port my old PD? Should i wait for the old i-140 to be approved and then file for the new one or is there a way i can use the old i-140 later on during the 485 filing time to port the PD?
Any suggestion will be appreciated.

I think you can apply for I-140 with a copy. As far as I know, you cannot use premium processing though.

Here's a sticky question - and appreciate "expert" advise on the matter:

1. I currently work on a H1B for Company A
2. My future greencard has been filed by Company B - recd. EAD, applied 485
My question:
1. Can I work on my EAD either for company A or any other company?
Yes, you can work for any company, but with similar job description mentioned in your LC
2. What happens if I dont join Company B ever?
well this is a broad subject, I'll try to put it this way.
when you applied for AOS which I suppose is employment based, your intent is to work with the sponsoring employer on a "permanent position" (at least 6 months after the GC approval) and your sponsoring employers intent is to employee you on permanent position (again atleast 6 months after GC approval), so by never joining your sponsoring employer you are violating/contradicting the primary intent of Employment based AOS application which can lead to revoking of your GC in future or it might cause problems during your naturalization

Hi immigration Gurus,
I am in kind of situation where I need the guidance from the experts and knowledgeable . I was working for a company A(IT Product development company) who filed my GC around FEB 2007 in EB2, Aug 2007 filed my I140 and I485 concurrently, In Oct 2008, I left the A Company and moved to Company B on H1B,the company B immigration lawyers did not file AC21, as there reason was we don't want to get unnecessary attention on the GC process and told if any any RFE we will look at it, right now I got a good offer with Company C and have to move for a better medical insurance. Looking at the GC Labour petition, it is given as a product manager with the Company A and the OES code is pointing to some manufacturing production manager as there is no such as product manager in the computer OES code. Right now the company C I am moving is a Technical Lead position, so how to go about or is there any advice for this, if I am moving on the EAD and how to file the AC21 so that I don't get any RFE.
Your guidance is greatly apprecaite.

You are on AOS PENDING status. Since u've a valid H1 stamped in ur passport, you are free to roam in-and-out of the country without any issues.
Your H-1 will be invalid until your 485 is approved or you use EAD to work or AP to re-enter US.

I recently started work with a new employer using my EAD. I have a pending RFE on my 485 which I have to respond to in a couple of weeks. However, today I noticed that my 485 got a soft LUD of the day following the day I started with my new employer. My new employer uses eVerify but I didnt expect that it could be linked with a pending 485. Maybe I am wrong but I see no reason for the USCIS to touch my 485 until I have responded to the RFE.
Has anyone else noticed something similar when you started with a new employer using eVerify?

Can a felony conviction by a sponsor affect the person being sponsored? If they get deported will it result in any punitive action against the person being sponsored? Is there a time limit where a sponsor can't affect the person being sponsored by committing a crime?

Federal Reserve Chairman Ben Bernanke said that on September 15, 2009, the worst recession since the 1930s is probably over, although he cautioned that pain - especially for the nearly 15 million unemployed Americans - will persist. It shrank at a 1 percent pace in the second quarter, much slower than in previous quarters. While many on Wall Street have been encouraged by early signs of stabilization in U.S. home prices and hope the housing market may have hit bottom, others aren't so sure.

And his remarks came on the same day that the government report that retail sales jumped 2.7 percent in August, the most in more than three years. All this helped to lift stocks on Wall Street. This is a very sad message this morning I got to read from my inbox. I am not bothered about losing the pledge, but I am shocked to see only 88 members pledged. The sadest part is that this pledge is created by a US Citizen for IV.

Why only 88 pledged? Many people wants free ride which they cannot get if they dont want to unite for the common cause. I know most of the H1b holders are paid well and spend a lot. But when it comes to donate, they feel $1 equivalent to $1000. The reason is they feel they are not getting anything in return which is not true and they feel they are smart to get a free ride when others donate.
If you dont unite for the common cause, everyone including is going to struggle to get what you want. But at least the donated members will feel good about trying their best.
